Welcome to Bowling Chatter. These Terms of Service ("Terms") govern your use of the Bowling Chatter website, mobile applications, and services (collectively, the "Service") operated by Bowling Chatter ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Description of Service

Bowling Chatter is a service management platform designed for bowling centers. The Service enables communication between front desk staff and service bay technicians through real-time notifications, messaging, and task management.

2. Account Registration

To use the Service, your bowling center must have an active subscription. Access is provided through location-specific credentials. You are responsible for:

Maintaining the confidentiality of your access credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use

3. Subscription and Payment

The Service is provided on an annual subscription basis. Subscription terms include:

Fees are billed annually in advance
Subscriptions automatically renew unless cancelled
Refunds are provided in accordance with our refund policy
Prices are subject to change with 30 days notice

4. Acceptable Use

You agree to use the Service only for its intended purpose of managing bowling center service communications. You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service or servers
Transmit any malicious code or harmful content
Share your access credentials with unauthorized parties
Use the Service to harass, abuse, or harm others

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Bowling Chatter and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.

6. User Content

You retain ownership of any content you submit through the Service (messages, notes, etc.). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service. You are solely responsible for the content you submit.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

Scheduled maintenance (we will attempt to provide advance notice)
Emergency repairs or updates
Circumstances beyond our reasonable control

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOWLING CHATTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Bowling Chatter and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

Your right to use the Service will immediately cease
We may delete your account and associated data
Provisions that by their nature should survive termination will remain in effect

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bowling Chatter regarding the Service and supersede any prior agreements.
